Maternity benefit to be given even if leave /notice not given in prescribed format: Delhi HC

Delhi High Court in ShachiGahoi vs. Indian Agricultural Statistics Research Institute &Ors. (W.P. (C) 10521/2019) held that if a female employee applies for leave by giving the reason of pregnancy, even though the communication/e-mail/letter for leave is not in the required format, she cannot be deprived of her benefits provided under the Maternity Benefit Act, 1961.
