Supreme Court in ESI Corporation vs. M/s Endocrinology and Immunology Lab [Civil Appeal No. 3368 of 2012] on August 2, 2023 held that the provisions of ESI Act will be applicable to a pathological laboratory from the date when the Kerala Government issued a notification to bring the medical institutions including pathological labs under the purview of the ESI Act and not the date when the circular was issued by ESI covering medical institutions including pathological labs under the purview of the ESI Act.
