The Karnataka HC in the case of Management of KSRTC vs. Sri K. Shivaram W.P. No. 17583 of 2017, while examining the question as to whether labour court is an appropriate forum and has jurisdiction under Section 33C (2) of the Industrial Disputes Act, 1947 (“IDA”) to adjudicate claim under the Employees’ Compensation Act, 1923 (“ECA”), has held that in view of the specific forum provided under the ECA, the labour court had no jurisdiction to entertain the claim petition.
