Employee can access colleague’s service records under RTI Act to pursue service litigation: Karnataka HC

Karnataka High Court in AS Mallikarjunaswamy vs. State Information Commissioner &Ors. [Writ Petition No. 23695 of 2022] held that an employee who has filed an application under Section 8(1)(j) of the Right to Information Act, 2005 (“RTI Act”) is entitled to know the service particulars/information of other employees working under the same employer especially when the information provides the substratum for structuring his claims in service law such as confirmation, seniority, promotion and the like.
