Karnataka HC the case of Chief Administrative Officer &Anr. vs. MallappaBasappa Sajjan (W.A. No. 860/2025 (S-RES)), upheld the reinstatement of an employee whose appointment had been cancelled for allegedly not disclosing a prior conviction for a petty offence. The Court observed that there was no clear evidence of intentional suppression of the conviction during background verification, and the cancellation order did not specifically cite concealment as the basis. Relying on the Supreme Court’s decision in Avtar Singh vs. Union of India [(2016) 8 SCC 471], the Court reiterated that while rigorous standards may apply for sensitive or high-ranking posts, a lenient view is warranted for lower-tier positions such as a peon. The Division Bench found no error in the single judge’s decision and upheld the order directing reinstatement.
