Even for Fixed-term employee Stigmatic Termination Without Inquiry is Illegal

High Court of Jammu & Kashmir and Ladakh in Dr. Shazia Salam v. UT of J&K and Others [WP(C) No.494/2023] on August 1, 2025, held that termination of a contractual employee on stigmatic grounds, such as being labelled “vulnerable” or “unsuitable” for government service, without conducting a proper inquiry or issuing a show cause notice violates principles of natural justice. Citing U.P. SRTC vs. Brijesh Kumar (2024), the Court clarified that even fixed-term or temporary staff are entitled to procedural safeguards where the termination order is punitive or based on misconduct.
