Kerala High Court in Korambayil Hospital & Diagnostic Centre (P) Ltd. &Anr. vs. State of Kerala & Ors (WP (C) No. 34023/2022), ruled that the actual duties performed by an employee take precedence over their job title in determining eligibility for minimum wages. The employer contended that the employees were designated as “cleaners” and therefore entitled to lower minimum wages. However, the Court, after examining the factual work being performed, found that the employees were carrying out the duties of housekeepers. As such, they were held to fall within the category covered under the minimum wage notification applicable to private hospitals and were thus entitled to higher minimum wages.
