Allahabad High Court, in Rajendra Prasad Tripathi vs. Hindustan Aeronautics Limited Through Chairman (WA No. 3653/2001), affirmed the employer’s decision to remove an employee’s name from the organization’s rolls in accordance with the certified standing order, which has provided that if a worker is absent without authorization for more than 10 days, the minimum requirement is to issue a show-cause notice. The Court dismissed the employee’s argument that he had submitted several representations via under postal certificate (which is not registered) to advocate for his absence from duty. The Court noted that the employee’s approach was not commendable, as no registered documents were sent to the opposing party, nor was any application delivered through an appropriate method within the organization. The proof of receipt of an under postal certificate is a document that lacks reliability, and no trust can be placed on such a document due to its lack of evidentiary value.
