Rajasthan High Court in Shravan Choudhary vs. State of Rajasthan & Ors. (S.B. Civil Writ Petition No. 4298/2025) held that an employee cannot be terminated solely on the basis of a show-cause notice without issuing a formal charge sheet or holding a disciplinary inquiry. The Court noted that the employee, appointed in 2023, was terminated in 2024 on allegations of securing employment through fraudulent documents, without following the prescribed procedure under the service rules. Emphasising that “an order of termination in service law is like capital punishment and must be preceded by a proper inquiry,” the Court quashed the termination and directed reinstatement of the petitioner.
