Gujarat High Court in X vs. State of Gujarat & Ors. (CA No. 6689/2025 recently) granted an additional week of leave to an employee who had filed a complaint of sexual harassment against a colleague seated next to her. The Court held that the leave, granted under Section 12 of the PoSH Act, shall remain in effect until the IC concludes its inquiry. This leave is supplemental to the employee’s regular leave entitlement and is intended to safeguard her well-being during the ongoing proceedings.
