Calcutta High Court, in State of West Bengal & Ors. vs. Bansi Badan Kole &Anr. [MAT 665 of 2025], held that pension benefits cannot be denied solely due to a deficiency in qualifying service attributable to the employer. The Court observed that prolonged litigation and administrative lapses delayed the employee’s appointment by over a decade, resulting in a three-year shortfall in qualifying service. Emphasising that a pension is a vested right in the nature of property, the Court held that denial of such benefits would defeat the welfare objective of the scheme. It directed the competent authority to condone the deficiency and ordered the expeditious disbursement of pension and consequential benefits.
