Jharkhand High Court, in Ranchi University vs. Shanti Devi & Ors. [L.P.A. No. 482 of 2024], held that employers cannot withhold statutory retirement benefits such as pension, gratuity, and leave encashment merely due to pending criminal proceedings without conviction. The Court reiterated that a pension is a vested statutory right, partaking the character of deferred salary, and not a bounty at the pleasure of the employer.
