Meghalaya High Court, in Lorento Convent School & Ors. vs. Employees Provident Fund Organization, Ministry of Labour and Employment, Government of India & Ors. (W.P.C No. 456/2022), on June 6, 2025, quashed the order issued by the Regional Provident Fund Commissioner (“RPFC”), which sought damages and interest under Sections 7Q and 14B of the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 (“EPF Act”). The Court observed that the timeframe for which the damages and interest were being demanded had already been adjudicated and resolved through earlier judicial intervention. Accordingly, it held that the RPFC had no authority to re-evaluate or reassess the same period, as doing so would amount to revisiting a matter already settled by the Court.
