Haryana Issues Guidelines for Night Shift Working of Women in Factories & Commercial Establishments

Government of Haryana issued mandatory guidelines for factories covered under the Factories Act, seeking exemption for engaging women workers between the hours of 7.00 p.m. and 6:00 a.m. Employers must obtain written consent from the women workers and ensure compliance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (” PoSH Act“), including procedures for resolution, submission of annual return to the District Authority and Labour Commissioner, Haryana. The occupier must engage women workers in batches of 4 women in the factory, install CCTV cameras in all sensitive and entry/exit locations, and provide secure transportation with female security guards and communication channels. Women workers must be allowed to opt out of these transportation facilities. The employer may tie up with external transporters to provide transportation facilities, provided that the service provider carries out the collection of biodata and pre-employment screening of the drivers. The employer must engage at least one female security guard during the night shift. Additionally, employers must maintain medical facilities, ensure display of emergency contact numbers, and report any untoward incidents to the Assistant Director concerned, Industrial Safety & Health, and the local Police Station immediately. The application for exemption should be made online within 2 weeks of the start of the night shift of women employees, and it will be approved and notified in auto mode based on self-certification and will remain valid for 1 year.

Shops & Commercial Establishments
Government of Haryana issued mandatory guidelines for IT, ITeS, Banking establishments, three-star or above hotels, hundred per cent export-oriented establishments, logistics and warehousing establishments covered under the Punjab Shops and Commercial Establishments Act, 1958 (“Haryana Shops Act“). The employer must obtain written consent from the women workers and ensure compliance with the PoSH Act, including procedures for resolution, submission of annual return to the District Authority and Labour Commissioner, Haryana. Proper lighting, medical support, security guards, and transportation (with optional opt-out by consent) must be provided, and female guards are required in vehicles. Establishments may pool transport with external vendors. Women must work in batches of at least four, except senior employees (earning ₹1,00,000/- per month) in IT/ITeS sectors, provided they consent to work in the night shift. Additionally, employers must maintain medical facilities and ensure the display of emergency contact numbers in prominent places in the establishment. Where boarding and lodging are offered, they must be exclusively supervised by women wardens. The establishments must also comply with the Employees’ State Insurance Act, 1948, and the Punjab Labour Welfare Fund Act, 1965 (as applicable in Haryana). The application for exemption should be made online within 2 weeks of the start of the night shift of women employees, and it will be approved and notified in auto mode based on self-certification and will remain valid for 1 year.
