Himachal Pradesh High Court in Dr. Daljit Singh v. State of H.P. & Ors. (CWP No. 3374 of 2024) rejected the employer’s contention that employees, who were originally recruited as regular employees, cannot derive the benefits of enhanced retirement age, which was provided only to persons with disabilities. The employee in this case had sought the benefit of extended retirement age as he had acquired locomotor disability assessed at 51% permanent physical impairment during his employment. The court emphasised that disability does not lose its character merely because it was acquired during service, and denying such employees the benefit of extended retirement age amounts to discrimination. Accordingly, the Court directed that the employee be given the benefit of extended retirement age up to 60 years.
