Employer cannot cancel Compassionate Appointment once verification is done

Rajasthan High Court, in Sagar Kumar vs. State of Rajasthan (S.B. Civil Writ Petition No. 725/2025), on July 8, 2025, set aside the termination of an employee appointed under a compassionate appointment scheme. The employee’s appointment had been confirmed after verification of all documents, including disclosure of marital status and the fact that he had 3 children at the time of appointment. A complaint was later filed alleging ineligibility due to having more than 2 children. Despite the employee clarifying that no information had been suppressed and that complete disclosure was made before joining, the employer terminated his services after 15 years of clean service. The Court held that in the absence of fraud or concealment, and since the department had verified the documents before appointment, terminating the employee after such a long period was unjustified and defeated the welfare objective of compassionate appointments. Accordingly, the termination order was quashed, and the employee was reinstated.
