Employee entitled to compensation if injured During Duty

Madras High Court, in Tamil Nadu State Transport Corporation (Villupuram) Limited vs. N. Vadivel (C.M.A No. 2977/2022),on June 6, 2025,  upheld the order of the Commissioner for Workmen Compensation, who had awarded compensation under the Employees’ Compensation Act, 1923 (“EC Act”) to a conductor who sustained total permanent disability in a road accident. The Court first addressed the employer’s contention that the claim should be barred due to a delay of over 2 years in filing and held that there was sufficient justification to condone the delay. It then turned to the employer’s second argument—that the conductor was not in the course of employment at the time of the accident—and rejected it, noting that there was no plausible reason for the conductor to have been present in the employer’s vehicle unless he was indeed on duty. Therefore, the Court concluded that the employee was entitled to compensation.
