Contractual employee is also entitled to maternity benefits

Orissa HC  in State of Odisha & Another vs. Smt. Anindita Mishra (W.A. No. 1074/2023) considered whether a contractual employee is entitled to maternity benefits under the prevailing state policy. The Court affirmed that maternity benefits cannot be denied merely because an employee is on contract. It clarified that the distinction between a legislated policy and one issued through executive action is immaterial when it comes to granting maternity benefits to contract or regular employees alike.
