Government of Bihar, exercising powers under Section 66 of the Factories Act, 1948 (“Factories Act”), on June 6, 2025, permitted the employment of women in night shifts across all factories registered under the Factories Act, subject to the conditions that written consent must be obtained before assigning any woman to night shifts, employers cannot compel any women worker to work during night hours, and refusal to do so shall not be considered misconduct or grounds for termination, the employer must provide safe transportation with CCTV-fitted vehicles, adequate lighting and surveillance in and around the workplace, and retaining CCTV footage for at least 45 days. Any non-compliance would attract the penal consequences prescribed under the Factories Act.
