The Minimum Wages Act, 1948 is one of the most important labour law legislations in India. This legislation was specifically enacted to give employees various benefits and guarantee that minimum rates of wages are paid by employers. This importance is evidenced by the high number of cases involving the Minimum Wages Act delivered by the various courts in the country, which are continuously interpreting the provisions of the Act in newer light and newer contexts.
It is a beneficial social legislation which protects the day to day living conditions of workers employed at the lowest level of wages of sweated labour Also the act was not intended to apply to all industries and trades but only to those where by reason of unorganized labour or for want of proper arrangements for effective regulation of wages or other causes workers’ wages were very low. Because of this schedule is attached to the Act to identify the trades/ employment on which it has been made applicable. However, in the upcoming Code of Wages, which is yet to be enforced, this schedule has been removed and minimum wages have been made applicable to all trades. to wages.
It was due to an increase in disputes related to the Minimum Wages Act and the various interpretations given by these cases as well as amendments in light of India’s recent push towards a more liberalised economy, that a need is felt to revise and update this book with the latest case laws and amendments.
