Pending Dispute, If Labour Court Permits, retrenchment would be valid

Madhya Pradesh High Court in Ram Das Sahu and Others vs. The State of Madhya Pradesh and Others (WP No. 10838/2008) upheld the retrenchment of a daily wage worker during the pendency of an industrial dispute. The Court held that once the Labour Court permitted the employer to proceed with termination, compliance with Section 33 of the ID Act, was satisfied. It also accepted the employer’s claim that compensation was offered but declined by the workers and subsequently dispatched via registered post.
