Maternity leave must be entered in service record

Madras High Court in Dr. E. Krithika vs. State of Tamil Nadu and Others (W.A. (MD) No. 860 of 2023) ruled that maternity leave must be treated as part of the mandatory service period under a bond. The Court set aside the employer’s decision to withhold the employee’s discharge certificate on the ground that she had not completed the full two-year service obligation, noting that her maternity leave period was wrongfully excluded from the calculation. The Court held that maternity leave is a statutory entitlement and cannot be treated as a break in service for the purposes of bond compliance.
