Rajasthan High Court in Sharvan Choudhary vs. State of Rajasthan & Ors. (S.B. CWP No. 4298/2025),on May 8, 2025, reinstated an employee whose services were terminated solely on the basis of a show cause notice and the employer’s dissatisfaction with the employee’s reply. The Court noted that no formal charge sheet had been served, nor any disciplinary inquiry conducted prior to the termination, thereby rendering the employer’s action procedurally defective. It underscored that a termination order in employment law carries consequences akin to capital punishment in criminal law, and therefore, must be preceded by a comprehensive and fair inquiry to avoid the unjust dismissal of an employee.
